Terms & Conditions

By proceeding with your reservation, you (“Renter”) agree to the following terms with Bum Beach Rentals.

1. Rental Delivery & Return

All equipment is delivered to the residential or lodging address provided during booking.

Delivery Scope & Limitations
Bum Beach Rentals provides delivery to residences, vacation rentals, and approved lodging locations only. We do not deliver to beaches, public beach access points, parks, or other non-residential locations. We do not provide beach setup, installation, or breakdown services. All equipment is delivered for customer self-setup and use.

Renter agrees to leave all equipment in the original delivery location for pickup at the scheduled time. Items must be accessible at pickup. Additional charges may apply if:

  • Items are not available at the scheduled pickup time

  • Items are moved without notice

  • Access to the delivery location is restricted or delayed

Renter is responsible for providing accurate delivery information and ensuring safe access to the property.

2. Rental Period

Rental periods are based on the dates and times selected at booking.

Equipment not available for pickup at the scheduled time may incur additional daily rental charges.

3. Care & Use of Equipment

All equipment is for personal recreational use only.

Renter agrees to:

  • Properly set up and secure equipment according to manufacturer guidelines

  • Discontinue use during unsafe weather conditions including high winds, lightning, or storms

  • Protect equipment from theft, damage, and extreme weather

Equipment should not be left unattended in public areas for extended periods and should not be left outside overnight when possible.

Rental equipment may only be used by the Renter and members of their party. The Renter remains responsible for all items during the rental period.

4. Cleaning, Damage & Loss

All equipment must be returned in clean condition.

A $25 cleaning fee may be charged if gear is returned excessively sandy, dirty, or requiring additional cleaning.

Renter is financially responsible for damaged, lost, or stolen equipment, including replacement costs. Sample replacement costs include:

  • Shibumi Shade – $300

  • Shibumi Wind Assist – $40

  • Shibumi Beach Chair – $175

  • Cooler – $400

  • Speaker – $200

  • Beach Wagon – $200

Actual replacement cost may be charged if higher.

5. Payment & Security Authorization

All reservations must be paid by credit card only. Bum Beach Rentals does not accept cash or other payment methods.

By completing your booking, you authorize Bum Beach Rentals to charge your credit card for:

  • Rental fees

  • Cleaning fees

  • Damage fees

  • Replacement of lost or stolen equipment

  • Additional rental time if pickup is delayed

A temporary hold may be placed on your card as a security deposit.

6. Chargeback & Payment Dispute Policy

By completing a reservation and agreeing to these Terms & Conditions, the Renter acknowledges that the rental service has been reserved and inventory has been allocated.

The Renter agrees not to initiate a credit card chargeback or payment dispute for charges that are valid under this agreement, including rental fees, damage fees, cleaning fees, or replacement costs.

If a billing concern arises, the Renter agrees to contact Bum Beach Rentals directly to resolve the issue before initiating a dispute with their credit card provider.

7. Cancellation & Weather Policy

Cancellation policy:

  • 48+ hours before delivery: Full refund

  • 24–48 hours before delivery: 50% refund

  • Less than 24 hours: No refund

Weather-related refunds are not provided unless local beaches are officially closed by authorities.

8. Assumption of Risk

Renter acknowledges that the use of beach equipment involves inherent risks including but not limited to wind-related hazards, shifting sand, lifting injuries, and environmental conditions.

The Renter voluntarily assumes all risks associated with the use of the equipment.

9. Liability Waiver

Renter assumes all risks associated with the use of rental equipment.

Bum Beach Rentals is not responsible for any injury, accident, property damage, or loss resulting from the use or misuse of rental equipment.

By renting equipment, the Renter agrees to release and hold harmless Bum Beach Rentals from any claims, liabilities, or damages arising from equipment use.

10. Indemnification

Renter agrees to indemnify, defend, and hold harmless Bum Beach Rentals and its owners, employees, and agents from any claims, damages, losses, liabilities, or expenses arising out of or related to the use, misuse, or possession of rental equipment during the rental period.

11. Limitation of Liability

To the fullest extent permitted by law, Bum Beach Rentals’ liability for any claim related to this rental shall not exceed the total amount paid for the rental.

12. Minimum Age Requirement

The Renter must be at least 18 years of age and legally authorized to enter into this agreement.

13. Force Majeure

Bum Beach Rentals shall not be liable for delays or failure to perform due to circumstances beyond its reasonable control, including severe weather, natural disasters, road closures, government restrictions, or other unforeseen events.

14. Right to Refuse Service

Bum Beach Rentals reserves the right to refuse service or cancel reservations if rental terms are violated or if equipment availability changes.

15. Governing Law

This agreement shall be governed by and interpreted in accordance with the laws of the State of South Carolina.

Agreement Acknowledgment

By completing a reservation with Bum Beach Rentals or through a third-party platform, the Renter acknowledges that they have read, understood, and agree to these Terms & Conditions.
